Understanding the Payment of Bonus Act: A Simplified Guide

Who is Covered by the Act?
The Act applies to:
– Every factory.
– Any establishment employing more than 20 people during any day of the financial year.

Eligibility for Bonus:
To qualify for a bonus, an employee must:
– Have worked for at least 30 days in the financial year.
– Earn a salary of Rs. 10,000 or less per month.

Calculating the Minimum Bonus:
The minimum bonus is 8.33% of the employee’s annual salary. However, it’s crucial to understand what constitutes ‘salary’ for this calculation. The wages for bonus calculation includes only the Basic Pay and Dearness Allowance (DA), excluding components like:
– Overtime
– House Rent Allowance (HRA)
– Light and Water Allowance
– Medical and Travel Concessions
– Employer’s contribution to Provident Fund (PF)
– Incentives or Commissions
– Retrenchment Compensation
– Production, Attendance Bonuses
– Gratuity
– Retirement Benefits
– Ex Gratia Payments
– Other Temporary Payments

Case Examples for Bonus Calculation:
1. If Basic + DA is less than Rs. 3,500
 For instance, if Basic + DA totals Rs. 2,500, the calculation would be:  
 Annual Salary (Rs. 2,500 x 12 months) x 8.33% = Bonus Amount.

2. If Basic + DA is Rs. 3,500 or more
   For example, if Basic + DA is Rs. 5,000, the calculation would be:  
  Annual Salary (Rs. 5,000 x 12 months) x 8.33% = Bonus Amount.
Important Note:
Employees earning more than Rs. 10,000 per month are not eligible for the bonus under the Payment of Bonus Act, 1965.
